Regulation Amending The Regulation on License in Electric Market Has Been Published 27 July 2018

Regulation Amending the Regulation on License in Electric Market has been published in the Official Gazette dated 09.07.2018 and numbered 30473.

Within that respect; according to the amendments made in Articles 12 and 20 of the Regulation on License in Electric Market (“the Regulation”), in the event that the legal entities that will apply for the pre-license or license in the electricity market are incorporated as joint stock company, all of their shares, apart from those to be issued for trading on the stock exchange shall be registered shares and the company shall not issue bearer shares other than those to be issued for trading on the stock exchange. Within this scope; it is obligatory for the companies that they shall stipulate these conditions under their articles of association.

Additionally; pursuant to the amendments made in the Regulation, the legal entities that operate in electricity market and own pre-license shall obtain a project or final project approval within the period of pre-license in order to be able to commence the construction of the production facility subject to the pre-license.
