What Are The Required Conditions to Acquire Montenegrin Citizenship? 22 March 2019

From time to time, the decisions of the Montenegrin Economic Citizenship Program (“Program”) and the procedures and criteria for acquiring Montenegro citizenship are shared with the public by the Montenegrin government.

In light of recent developments, with the decision published in the Official Gazette of Montenegro no 79/2018 “The Decision on Criteria, Method and Procedure for Selection of Persons Who May Acquire Montenegrin Citizenship by Admission for the Implementation of a Special Investment Program of Particular Importance for the Business and Economic Interest of Montenegro” (“Decision”) has entered into force on January 1, 2019 and will continue until 31 December, 2021. The applications to be accepted in this period are limited to 2000 foreign investors.

According to this, the criteria and procedure required to acquire Montenegrin Citizenship by investing in the program are as follows:

Application:

Applicants can apply to the citizenship program via intermediary institutions through this investment and control of applications will be carried out by an international conformity assessment body.

Application Requirements:

In order for a foreign investor to be eligible for Montenegrin citizenship, the applicant must not be convicted under a binding court decision in Montenegro or another country. In addition, the investor should have received a positive opinion from an international eligibility assessment agent, including the money and the proof of the origin of the money intended for payment and investment under this Decision.

Criteria and Procedure in Passport Applications:

According to the Decision published in the Official Gazette of Montenegro, the foreign investor who will apply for citizenship must fulfill the following requirements:

Deposit an amount of EUR 100,000 to the escrow account for the development of underdeveloped local self-government units,
Deposit an amount of 450,000 to the escrow account for the purpose of investing in one of the development projects in the Capital City of Podgorica or the coastal zone of Montenegro; OR at least EUR 250,000 for the purpose of investing in one of the development projects in the northern or central region of Montenegro, not including the Capital City of Podgorica.

At this point, these amounts will be transferred to a special fund in order to be utilized especially in the infrastructure development financing of the underdeveloped municipalities in the northern part of the country. Finally, the process of verification of payments and monitoring of investments in development projects will be carried out by an independent auditor appointed to serve this purpose.

The requirements of foreign investors are listed above, and by the applicants within the framework of the procedures and principles shared by the Government of Montenegro;

15.000 Euro deposit for individual passport applications,
In addition, up to 4 family members, each family member for the 10.000 Euro deposit,
For the family members after the fourth; EUR 50.000 for each additional person is required.

Scope of Investment Projects:

The scope of investments in the special investment program determined in line with the Decision is determined by the government as follows:

Minimum criteria for Hotel or Mixed Touristic Hotels in Montenegro's coastal area or capital Podgorica;

Minimum 5 stars
Minimum 60 rooms available
Minimum amount of investment is 15.000.000 Euro
Minimum 80 employees

Except for the capital city, the minimum criteria for investment in the northern and inland regions;

Minimum 4 stars
Minimum 35 rooms available
Minimum amount of investment is 5.000.000 Euro
Minimum 80 employees

With the Decision, it is aimed to provide input to the national economy by giving citizenship under the special investment program for foreign investors and to improve the tourism sector especially in Montenegro.

In this direction; in order to invest and acquire citizenship within the framework of the program, it is useful to have a consultancy service and to carry out all processes under the supervision of this consultant.
