Guidelines on Vertical Agreements has been updated 3 April 2018
Guidelines on Vertical Agreements (“the Guidelines”) of the Competition Authority (“the Authority”) has been updated and published on the website of the Authority. It has been observed that the new paragraphs added to the Guidelines mainly concerns Internet sales and most favored customer clause (“MFC Clause”).
As the only regulation in our legislation about Internet sales was a statement referred that Internet sales were regarded as passive selling method, the Authority have made new explanations on this area in which the consumer and seller balance should be provided.
Nevertheless, because of the widespread Internet sales, updates on MFC Clauses have been needed and various sections have been added to the Guidelines within this regard.
