Installation of Rooftop Solar Power Plants (SPP) and Regulations of Related Legislation 2 May 2018

Due to the increase of market share of renewable energy sources and these sources being both environmental friendly and economically advantageous, an important tendency has been observed towards this area in our country recently. Along with large-scale projects, important regulations are being entered into force by the legislator for the popularization of small scaled and rooftop SPPs as well and various resolutions are being published by Energy Market Regulatory Board (“EMRA”).

EMRA took the decision titled Principles and Procedures Regarding the Production Applications without License for Solar Power Plants Connected to Electric Market through the Same Measurement Point as Consumption Facility and Utilization of Excess Energy on the date of 28.12.2017 in order to determine the procedures and principles of application for the power plants depending on solar energy with roof and facade installations whose production and consumption are connected from the same point and utilization of excess energy.

In the said decision; how the power plant will be connected to the network, how and within which time periods should the distribution company do the transactions such as provisional acceptance, connection agreement and how will the excess energy be utilized have been regulated in addition to the application of consumers who wishes to establish rooftop solar power plant up to 10 KW power and principles regarding this application.

Following the promulgation of the aforementioned decision “The Law Amending the Tax Laws and Some Laws and Decree Laws” (“the Law”) published in the Second Repetitive issue of the Official Gazette dated 27.03.2018 is also one of the significant regulations brought within this context.

In accordance with the addition to Article 9 of the Income Tax Law numbered 193 via Article 3 of the Law; sale of the electric energy produced from the solar power plants whose maximum power is 10 KW built on the roofs of the houses and their extensions by the homeowner natural persons or tenants to last source supply companies shall be exempted from income tax. The plants built by flat owners in order to supply the electric energy for the common needs of the estate shall enjoy tradesmen exception.

As it has been foreseen that more amendments will be made in our legislation within this regard; in order not to face any problems during the transactions made with the administration and distribution companies, it has significant importance to follow the relevant legislation by expert jurists and to establish relationships with respective institutions accordingly.
