Is It Possible to Obtain an E-2 Treaty Investor Visa by Making a Real Estate Investment in America? 22 January 2019

“E-2 Treaty Investor Visa” classified as Commercial Treaty Investor Visa is a nonimmigrant visa given to people who need going to the USA and being there for a while in order to make a significant trade between the USA and Turkey or to manage or develop the business in which he invested a substantial amount of capital.

E-2 Visa is granted for a period of maximum 2 years, but renewal is possible in two years periods as long as the conditions are maintained. Since an investor with E-2 visa has no obligation to live in the USA for a certain period of time, the investor may leave the USA at any time and stay outside the United States for as long as he or she wishes. This does not result in the cancellation of the visa.

Since E-2 Visa is a program for investors who want to stay in the US temporarily, Green Card or citizenship not given to investor as a result of investing within the scope of E-2 visa. Therefore, investors who have a residence permit in the US and invest in a country other than the US will not pay tax on the profits that they earn from these investments and will not have to declare them to the US government. However, if the owner of an E-2 visa wishes to proceed later, he / she may apply for an EB-5 visa by increasing the amount of investment in the USA and thus may have the right to win the Green Card. For all the above reasons; while continuing their life and commercial activities in Turkey, the E-2 visa provides significant advantages for investors who want to obtain income from the US by using investment opportunities in the United States and gaining the right to work and living in the United States.

However, the investments of Turkish investors in the USA are concentrated on real estate acquisition. Under normal circumstances, real estate acquisition does not entitle the applicant to apply for an E-2 visa. Because it is necessary to have a commercial activity to apply for an E2 visa, and most importantly, the amount invested should be 'at risk'. Therefore; buying an estate in the US and obtaining rental income is not sufficient to apply for an E-2 visa.

However, by establishing 'real estate management' companies that have become an important investment in the US, it will be possible to make real estate investments in the USA and apply for an E-2 visa through this company. Although the investment costs for these companies quite higher compared to other commercial companies, it is a golden opportunity for investors who cannot decide how to use their financial accumulation since the real estate investment will increase in value over time; it is possible to generate revenue outside of Turkey by means of monthly rental income, and the management costs are lower comparing with other business corporations.

On the other hand; we would like to remind you that every real estate management company will not ensure that you will receive an E-2 visa. Therefore, it would be beneficial to get a consultancy service before the establishment of the aforementioned company and relevant real estate investment, and that all the processes should be carried out through experienced professionals in their field.
